行政院提出會計法覆議案，民進黨立委李應元10日指出，應儘速引用｢大水庫理論｣，早日完成會計法修法，以平息社會爭議。

李應元指出，違反相關報帳規定被調查起訴的樣態很多，情節各有不同；雖有一些較為惡劣的案例，但大部分是在僵化報帳規定下，便宜行事所造成。他說，5月31日所通過的修正案，不考慮情節輕重，一律一筆勾銷，難怪社會輿論一片譁然。

李應元認為，社會能接受的是｢大水庫理論｣修法原則，況且過去在法院判決中也被採認過，只要公款公用，實際研究支出大於報支金額者，皆應免除其民刑事責任。

他說，一般估計約有八成左右案件，可望因此擺脫法律的糾葛，早日全心投入相關研究。

李應元指出，目前許多被調查偵辦的案件，實際購置項目與發票顯現內容不符，但都與研究有關；過去因為種種原因造成此結果，若都以貪汙罪論處，恐非大家所樂見，而未來將要求國科會讓研究計畫的報支更有彈性，之後一切便依規定辦理。
